Updated legal obligations for social housing providers

Since January 2023, the Fire Safety (England) Regulations 2022 require responsible persons in buildings over 11m to carry out annual checks of fire-fighting equipment including dry risers, and to keep written records. Failure to comply is a criminal offence.

Your Legal Obligations

Recent fire safety legislation has significantly expanded what housing associations and councils are required to do. Here's what applies to your stock.

Fire Safety Act 2021

Extended the Fire Safety Order to explicitly cover the structure, external walls, and flat entrance doors of multi-occupied residential buildings. Responsible persons must now assess and maintain all fire-fighting equipment including dry risers.

Fire Safety (England) Regulations 2022

From January 2023, responsible persons in buildings over 11m must carry out annual checks of fire-fighting equipment and keep records. Buildings over 18m have additional monthly and quarterly checks.

BS 9990:2015

The technical standard requiring annual pressure tests and six-monthly visual inspections of all dry riser systems. A test certificate must be held on site and available to the fire authority on request.

Regulatory Reform (Fire Safety) Order 2005

Places a legal duty on the responsible person to ensure fire-fighting systems are maintained in efficient working order. Non-compliance can result in enforcement notices, building prohibition, or prosecution.
